Minutes 6-16-09 Special Meeting

The Board of Selectmen held a special meeting on Tuesday, June 16, 2009 in the Lower Court Room of the Edmond Town Hall, 45 Main Street, Newtown, CT.  

CALL TO ORDER:  Selectman Mangiafico called the special meeting to order at 4:15 p.m.

PRESENT:  Selectman Paul Mangiafico, Selectman Herbert Rosenthal.

ALSO PRESENT:  Attorney David Zabel, Attorney Courtney George, five members of the public and one member of the press.

Atty. Zabel noted this was a continued hearing.  Under the Freedom of Information Act, the employee Carolee Mason has the right to have personnel matters discussed in public session as opposed to executive session.  She has exercised that right for the evidentiary portion of this hearing so far.   She and her council had informed the Board that for purposes of the Boards discussion of the evidence presented and deliberations concerning the possibility of either upholding, affirming, reversing or modifying the charge that she consent to the Board having those discussions in executive session.

Selectman Rosenthal moved that the Board of Selectmen enter executive session for the purpose of discussing the evidentiary portion of the hearing and to get legal advice
from the attorneys.  Invited were Attorney David Zabel and Attorney Courtney George.  Seconded by Selectman Mangiafico.  Executive session was entered into at 4:20pm and returned to regular session at 8:00pm with no motion.

Having no further business, the special meeting of the Board of Selectman was adjourned at 8:00pm to be continued on Wednesday, June 17, 2009 at 4:00pm at the C.H. Booth Library, Main Street, Newtown, CT.
